Damn, damn, damn.<\/p>\n<p>It turns out that the version of the Medical Innovation Bill about which I wrote <span style=\"text-decoration: underline\"><span style=\"color: #0000ff\"><a style=\"color: #0000ff;text-decoration: underline\" href=\"https:\/\/stg-blogs.bmj.com\/medical-ethics\/2014\/10\/28\/an-innovation-too-far\/\">this morning<\/a><\/span><\/span> isn&#8217;t the most recent: the most recent version <span style=\"text-decoration: underline\"><span style=\"color: #0000ff\"><a style=\"color: #0000ff;text-decoration: underline\" href=\"http:\/\/www.publications.parliament.uk\/pa\/bills\/lbill\/2014-2015\/0004\/lbill_2014-20150004_en_2.htm#l1g1\">is available here<\/a><\/span><\/span>. \u00a0Na\u00efvely, I&#8217;d assumed that the government would make sure the latest version was the easiest to find. \u00a0Silly me.<\/p>\n<p>Here&#8217;s the updated version of\u00a0\u00a71(3): it says that the process of deciding whether to use an unorthodox treatment<\/p>\n<blockquote>\n<p id=\"l1g1-l1p1-l2p3\" class=\"LegClearFix LegP2Container\"><span class=\"LegDS LegRHS LegP2Text\">must include\u2014<\/span><\/p>\n<p id=\"l1g1-l1p1-l2p3-l3p1\" class=\"LegClearFix LegP3Container\"><span class=\"LegDS LegLHS LegP3No\">(a)\u00a0<\/span><span class=\"LegDS LegRHS LegP3Text\">consultation with appropriately qualified colleagues, including any relevant multi-disciplinary team;<\/span><\/p>\n<p id=\"l1g1-l1p1-l2p3-l3p2\" class=\"LegClearFix LegP3Container\"><span class=\"LegDS LegLHS LegP3No\">(b)\u00a0<\/span><span class=\"LegDS LegRHS LegP3Text\">notification in advance to the doctor\u2019s responsible officer;<\/span><\/p>\n<p id=\"l1g1-l1p1-l2p3-l3p3\" class=\"LegClearFix LegP3Container\"><span class=\"LegDS LegLHS LegP3No\">(c)\u00a0<\/span><span class=\"LegDS LegRHS LegP3Text\">consideration of any opinions or requests expressed by or on behalf of the patient;<\/span><\/p>\n<p id=\"l1g1-l1p1-l2p3-l3p4\" class=\"LegClearFix LegP3Container\"><span class=\"LegDS LegLHS LegP3No\">(d)\u00a0<\/span><span class=\"LegDS LegRHS LegP3Text\">obtaining any consents required by law; and<\/span><\/p>\n<p id=\"l1g1-l1p1-l2p3-l3p5\" class=\"LegClearFix LegP3Container\"><span class=\"LegDS LegLHS LegP3No\">(e) <\/span><span class=\"LegDS LegRHS LegP3Text\">consideration of all matters that appear to the doctor to be reasonably necessary to be considered in order to reach a clinical judgment, including assessment and comparison of the actual or probable risks and consequences of different treatments.<\/span><\/p>\n<\/blockquote>\n<p class=\"LegClearFix LegP3Container\">So it is a bit better &#8211; it seems to take out the explicit &#8220;ask your mates&#8221; line.<\/p>\n<p class=\"LegClearFix LegP3Container\">However, it still doesn&#8217;t say how medics ought to weigh these criteria, or what counts as an appropriately qualified colleague. \u00a0So, on the face of it, our homeopath-oncologist could go to a &#8220;qualified&#8221; homeopath. \u00a0Or he could go to an oncologist, get told he&#8217;s a nutter, make a mental note of that, and decide that that&#8217;s quite enough consultation and that he&#8217;s still happy to try homeopathy anyway.<\/p>\n<p class=\"LegClearFix LegP3Container\">So it&#8217;s still a crappy piece of legislation. \u00a0And it still enjoys government support. \u00a0Which does, I suppose, give me an excuse to post this:<\/p>\n<p><iframe loading=\"lazy\" title=\"Edward Barton and the Baby Men :Government  Drugs\" width=\"640\" height=\"480\" src=\"https:\/\/www.youtube.com\/embed\/ov_UcobM3gI?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<p class=\"LegClearFix LegP3Container\">Many thanks to Sofia for the gentle correction about the law.<\/p>\n<p><!--TrendMD v2.4.8--><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Damn.
